The monument was donated to the Commonwealth of Kentucky in 1971 by the Fraternal Order of Eagles and was restored to the Capitol grounds on Dec. 17 in Frankfort, specifically in Monument Park. Its return was initially blocked by a court order based on the now-defunct Lemon test. First Liberty Institute represents Fraternal Order of Eagles Aerie 3423 in Hopkinsville, which kept the monument for more than 20 years and officially returned it to the state for placement on the Capitol grounds.
